Course Objectives:

By the end of this two half-day intensive and extensive learning experience, the participants shall have gained vast knowledge on the basic laws, jurisprudence and regulations on employment, labor standards, labor relations, labor procedures and labor jurisprudence, from hiring to retiring, and even beyond to include, labor-dispute settlement and resolution, to wit:

1.2) Employment, Recruitment and Hiring Laws
1.3) The Laws on Employing Foreign Workers and Executives
1.4) The Laws on Compensation, Salaries and Wages
1.5) The Laws on Benefits of Expats and Employees
1.6) The Laws on Health, Safety and Welfare
1.7) Benefits Arising from Disease, Disability and Death of Employees
1.8) The Laws on Labor Relations: Unions, Collective Bargaining and Strikes
1.9) The Laws on Grievance Handling, Labor Dispute Resolution
1.10) The Law on Outsourcing and Job Contracting
1.11) The Law on Termination of Employment and Separation of Employees


Course Outline:

FIRST DAY:
FOCUS ON EMPLOYMENT AND LABOR STANDARDS LAWS
  • (Books One, Two, Three and Four of the Labor Code of the Philippines, etc)
SECOND DAY:
PART I: FOCUS ON LABOR RELATIONS AND DISPUTE RESOLUTION, AND TERMINATION ON EMPLOYMENT/EMPLOYEE SEPARATION
  • The Right to Self-Organization: Unions, Federations, Etc
  • The Law On Certification Elections, Affiliations, Disaffiliations
  • The Right to Collective Bargaining: Cba’s, Etc
  • The Law On Unfair Labor Practices
  • The Law On Concerted Actions and Strikes and Lockouts
  • Grievance Machinery and Grievance Procedures
  • Labor-Management Committees (LMC)
  • Conciliation, Mediation and Assumption of Jurisdiction
  • Voluntary and Compulsory Arbitration
  • Appeals and Court Procedures
  • Reliefs and Remedies
PART II: FOCUS ON TERMINATION ON EMPLOYMENT/EMPLOYEE SEPARATION
  • The Management Prerogative to Discipline and Dismiss
  • The Employees’ Right to Security of Tenure
  • The Just Causes for Termination of Employment
  • The Authorized Caused for The Separation of Employees
  • Cases and Jurisprudence
