An Overview of Labor and Employment Laws

Many misconceptions, and therefore wrong solutions, to perceived labor problems, arise usually from a wrong appreciation of basic concepts in labor law. Thus, when is there an employer-employee relationship? When is contracting allowed? What are the minimum benefits required of an employer? What are the kinds of employment? What are the effects of an employee’s attaining security of tenure?
COURSE OBJECTIVE:
This seminar presents the basic laws and rules governing employment and contracting in the Philippine setting as well as the minimum labor standards required of employers, the legal consequences of union organization, the requirements for a valid dismissal, and the labor law enforcement machinery of the Government.
At the end of the seminar, the participants will be able to know the:
- distinction between employment and job contracting
- review various kinds of employment
- labor standards obligations of an employer
- the nuances of the rule against the non-diminution of benefits
- employer responsibility to address self organization efforts
· some basic rules on termination of employment for both just and authorized causes (including a review of cases involving dismissal for poor performance)
